CONTRACT:
DEPOSIT AND REFUND
A deposit in the amount agreed upon is required at the time of signing this agreement to secure the event date. The deposit is non-refundable 30 days or less prior to event date. Acceptable forms of payment are: major credit cards, Venmo, or Zelle.
BALANCE DUE AND REFUND
The final payment or balance of funds owed to Triumph Photoboooth is non-refundable 15 days or less prior to the event date. The final payment is due prior to the event date. Acceptable forms of payment are: major credit cards, Venmo, or Zelle. Photo booth services will not begin until the balance is paid in full. Payment for any overage in time must be paid before additional hours are provided.
PARKING
All parking expenses for Triumph Photobooth employees are the responsibilities of you, the Client. Photo Booth services will not be completed until parking expenses are paid, if they are not paid prior to the event. Parking must be provided within a reasonable distance from the photo booth set up location, or Photo Booth services may not be able to start at the scheduled time and at the Clients expense.
PHOTO BOOTH OPERATIONS
Triumph Photobooth agrees to have the photo booth operational for the time period agrred upon; however, in some situations operations may need to be interrupted for maintenance, service and/or photography optimizations. Triumph Photobooth agrees to have a qualified technician onsite to maintain and operate the photo booth. Should Triumph Photobooth fail to provide a fully operational photo booth during the agreed upon times, the client’s only remedy is a partial refund. Client agrees that Triumph Photobooth will not be responsible for consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then the rental charges shall be on a prorated basis.
PHOTO BOOTH SETUP/BREAKDOWN
Triumph Photobooth will deliver, setup, breakdown, and remove the photo booth from event location. Operation of photo booth times may be adjusted if event location, or client, ends the event prior to the contracted end time and no refund of money will apply. The Client will provide a setup area that is reasonably accessible and has level ground. Triumph Photobooth requires access to venue at least 60 minutes before the photo booth start time and 45 minutes after the photo booth end time for setup and breakdown.
SPACE & PLACEMENT REQUIREMENTS
Client agrees to provide:
(1) A minimum 8’ x 8’ area for our photo booth, which does not include the prop table which is a standard 6' table.
(2) 120V, 15-20 amps, 3 prong standard electrical outlet within 10-15 feet of our designated area. Triumph Photobooth will provide extension cords up to 15 feet. If additional extension cords are needed, the Client will provide those.
INCLEMENT WEATHER
Triumph Photobooth reserves the right, in good faith, to cease the operation should the weather pose a potential danger to our personnel, the equipment, or guests. If setup outdoors, Triumph Photobooth will not operate the Photo Booth if it is raining to any degree. Also, if the wind is over 6 miles per hour, the backdrop and backdrop stand may need to be taken down to avoid tipping over. Since safety is paramount in all decisions, Triumph Photobooth compensation will not be affected if operation is ended.
LIABILITY AND INDEMNIFICATION
Triumph Photobooth shall not be liable under any contract for direct, indirect, incidental or consequential damages (including without limitation, damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this agreement and services provided. Excluding any claims or liability regarding or related to transportation to or from Client's Event, Client will indemnify and hold harmless Triumph Photobooth, Triumph Photobooth employees, and any independent contractors working with Triumph Photobooth at time against any and all liability, claimed by third parties, not including Triumph Photobooth's employees, agents, or independent contractors, arising from Client's Event from the time of service.
DAMAGE TO TRIUMPH PHOTOBOOTH EQUIPMENT
Client acknowledges that it shall be responsible for any damage or loss to the Triumph Photobooth equipment caused by: a) any misuse of the equipment by Client or its guests, or b) any theft or disaster by client or guests, or c) loss of power or power surges to the photo booths at any time resulting in loss of pictures or damage of software and/or equipment
MODEL RELEASE (We will exclude this release upon request)
The Client and all guests using the photo booth hereby give to Triumph Photobooth: The right and permission to copyright and use photographic portraits, or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose.
