CONTRACT
DEPOSIT AND REFUND
A deposit in the amount agreed upon is required at the time of signing this agreement to secure the event date. The deposit is non-refundable 30 days or less prior to event date. Acceptable forms of payment are: major credit cards, Venmo, or Zelle.
BALANCE DUE AND REFUND
The final payment or balance of funds owed to Triumph Photoboooth is non-refundable 15 days or less prior to the event date. The final payment is due prior to the event date. Acceptable forms of payment are: major credit cards, Venmo, or Zelle. Photo booth services will not begin until the balance is paid in full. Payment for any overage in time must be paid before additional hours are provided.
PARKING
All parking expenses for Triumph Photobooth employees are the responsibilities of you, the Client. Photo Booth services will not be completed until parking expenses are paid, if they are not paid prior to the event. Parking must be provided within a reasonable distance from the photo booth set up location, or Photo Booth services may not be able to start at the scheduled time and at the Clients expense.
PHOTO BOOTH OPERATIONS
Triumph Photobooth agrees to have the photo booth operational for the time period agreed upon; however, in some situations operations may need to be interrupted for maintenance, service and/or photography optimizations. Triumph Photobooth agrees to have a qualified technician onsite to maintain and operate the photo booth. Should Triumph Photobooth fail to provide a fully operational photo booth during the agreed upon times, the client’s only remedy is a partial refund. Client agrees that Triumph Photobooth will not be responsible for consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then the rental charges shall be on a prorated basis.
PHOTO BOOTH SETUP/BREAKDOWN
Triumph Photobooth will deliver, setup, breakdown, and remove the photo booth from event location. Operation of photo booth times may be adjusted if event location, or client, ends the event prior to the contracted end time and no refund of money will apply. The Client will provide a setup area that is reasonably accessible and has level ground. Triumph Photobooth requires access to venue at least 60 minutes before the photo booth start time and 45 minutes after the photo booth end time for setup and breakdown.
SPACE & PLACEMENT REQUIREMENTS
Client agrees to provide:
(1) A minimum 8’ x 8’ area for our photo booth, which does not include the prop table which is a standard 6' table.
(2) 120V, 15-20 amps, 3 prong standard electrical outlet within 10-15 feet of our designated area. Triumph Photobooth will provide extension cords up to 15 feet. If additional extension cords are needed, the Client will provide those.
INCLEMENT WEATHER
The Photo Booth utilizes highly sensitive touchscreen computers, digital cameras, lighting equipment, and backdrops that cannot safely operate in adverse weather, direct sunlight, or extreme heat. Triumph Photobooth reserves the right, in good faith, to delay, suspend, relocate, or cease operations whenever environmental conditions may pose a risk of damage to equipment or a danger to personnel or guests.
Rain and Moisture Protection: Triumph Photobooth will not set up or operate outdoors when there is active precipitation, a reasonable likelihood of precipitation during the scheduled service period, or other physical indicators of rain, unless the entire Photo Booth setup is located under a full, waterproof overhead structure, such as a solid canopy, tent, or permanent structural roof. The protective structure must adequately shield the equipment, backdrop, and operating area from rain and moisture. If adequate weather protection is unavailable, the Client must provide a suitable alternative fully indoor setup area.
Wind Restrictions: If sustained winds or wind gusts exceed 6 miles per hour, the backdrop and backdrop stand must be dismantled and may not be operated outdoors until wind conditions return to a safe level. Triumph Photobooth may also suspend outdoor operations at lower wind speeds if, in its reasonable judgment, conditions create a safety risk. Safety remains the paramount factor in all operational decisions.
Temperature and Shade Requirements: The Photo Booth utilizes sensitive touchscreen computers, digital cameras, and other electronic equipment that may malfunction, overheat, or sustain damage when exposed to direct sunlight or excessive heat.
Temperatures Over 70°F (21°C): If the ambient temperature at the Photo Booth setup location exceeds 70°F, the Client must ensure that the entire Photo Booth setup and operating area remains under full, continuous shade, such as a solid canopy, tent, or permanent structural roof. The equipment may not be placed in direct sunlight.
Temperatures of 80°F (27°C) or Higher and/or Excessive Humidity: If the ambient temperature at the Photo Booth setup location reaches or exceeds 80°F, or if excessive humidity creates a risk of equipment malfunction or overheating, the Photo Booth must be moved to and operated within a fully enclosed, climate-controlled, air-conditioned indoor facility. Triumph Photobooth may require relocation to an air-conditioned environment at temperatures below 80°F if conditions otherwise create a reasonable risk of overheating or equipment damage.
Right to Suspend or Relocate Service: Triumph Photobooth reserves the right to immediately pause, suspend, relocate, or halt services to protect its equipment, personnel, and guests if the Client fails to provide a setup area that satisfies the weather, wind, temperature, shade, moisture, and environmental requirements stated above. The Company’s determination regarding whether conditions are safe for operation shall control.
Liability and Refunds: Triumph Photobooth shall not be liable for, and no refund, partial refund, credit, discount, or other compensation shall be owed for, lost operational time, delayed service, reduced service, or complete equipment shutdown resulting from the Client’s failure to provide a setup area that satisfies the required weather-protected, shaded, indoor, air-conditioned, or otherwise environmentally suitable conditions described above.
LIABILITY AND INDEMNIFICATION
Triumph Photobooth shall not be liable under any contract for direct, indirect, incidental or consequential damages (including without limitation, damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this agreement and services provided. Excluding any claims or liability regarding or related to transportation to or from Client's Event, Client will indemnify and hold harmless Triumph Photobooth, Triumph Photobooth employees, and any independent contractors working with Triumph Photobooth at time against any and all liability, claimed by third parties, not including Triumph Photobooth's employees, agents, or independent contractors, arising from Client's Event from the time of service.
DAMAGE TO TRIUMPH PHOTOBOOTH EQUIPMENT
Client acknowledges that it shall be responsible for any damage or loss to the Triumph Photobooth equipment caused by: a) any misuse of the equipment by Client or its guests, or b) any theft or disaster by client or guests, or c) loss of power or power surges to the photo booths at any time resulting in loss of pictures or damage of software and/or equipment
MODEL RELEASE (We will exclude this release upon request)
The Client and all guests using the photo booth hereby give to Triumph Photobooth: The right and permission to copyright and use photographic portraits, or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose.
